‍Content. “Content” means text, images, photos, audio, video and all other forms of data you (the “User”) upload on our website or mobile app. “Your Content” means content you upload or transmit through or in connection with the Service such as reviews, photos, images, videos, offer posters, banners and ads (for discounts or promotions), direct and indirect messages to us or any other relevant information you add and post on your user profile. “User Content” means content created and uploaded onto our website or mobile app in connection to the Service. “Third-Party Content” means all contents emanating from parties other than Bisame and its users, which is available in connection with the Service.

‍Accounts. “Business Account” means any account registered by a business on our platform through which you (the User) can access their services. “User Account” means account you register for on our website or mobile application to access the Service.

‍ABOUT THE WEBSITE

Bisame which is owned by Bisame Digital Ltd, a fully registered company Under the Ghana Company’s Act, is a platform that helps and assists (a) individuals locate local businesses, shops, hotels, motels, restaurants, and other companies (b)companies reached their target audience or market with their services (c)skilled workers or artisans to get gigs easily through our app (d) individuals leave reviews or rate businesses after being rendered a better service (As defined in the Terms below).

‍USING THE WEBSITE

‍Asa major condition pertaining to the use of our Service provided on the website,you agree to the stated terms; 

1. You have reached the age of majority in the state, province or country youreside. 
2. You can abide by legal obligations for our website. 
3. Your use of the website will comply with these Terms of Service at all times. 
4. You are not barred from using any products or service under applicable law. 
5. You have the right to provide any or all information you submit on the website, ensuring all such information are true, accurate, and current.

‍ACCESSING THE WEBSITE

We retain all right to deny service or use of the website or account to anyone at any time and for any reason. Your account may be inaccessible from time to time due to certain interruptions which may be within or outside our control, but we shall make every effort at having a system up time of 99.9% at all times so you can access your account.

You acknowledge that it’s your sole responsibility for securing and safeguarding the confidentiality of your Account details (email and login password) and that you are fully liable for any activity performed using your Account details. you understand and agree that we (Bisame) are not liable and responsible for any incident regarding your Account, Account settings and Account details.

Your account is non-transferrable. you cannot sell or share it with any other person. Any violation of these Terms of Service will cause you to fall out of good standing and lead to the cancellation of your account at our sole discretion. We reserve the right to suspend, withhold, or terminate your Account or your access to the Service, with or without prior notice, in case there is a breach of these Terms.

‍THE SERVICE

‍We (“Bisame”) offer individuals and businesses (Users) a convenient and easy way to create, post and advertise their services on our website. This is done through offer posters and flyers uploaded on their Account profile and other ad forms we provide. We reserve the right to block access to posts and offers by users without any notice in the event of the following;

1. Claim of holder of intellectual property rights to terminate infringement of his/her rights.
2. Detecting that posts or offers by user on the website or mobile application breaches these Terms or any applicable law.

You are responsible for any content you submit or upload on our website. We do not control your content and you acknowledge that we are not responsible for any User Content which does not conform to the Terms stated on this page.

‍REPRESENTATIONS AND WARRANTIES

‍By using the Service, you represent and warrant that;
1. You are of age of majority.
2. You shall provide timely, accurate and complete information in your Account.
3. You have the willingness to agree to or comply with the Terms stated on this page.
4. You shall update your information on your Account as and when you access the website.
5. You shall notify us of any breach or unauthorized access to your Account.
6. You shall immediately change your Account access details, if you suspect a disclosure of your Account data from any third party.

9. You shall not copy, modify, or distribute any other User Content without their consent.
10. You shall not collect information about other users, including emails addresses and phone numbers through our website without our consent.
11. You shall not download, store, or provide access to or in any other way use worms, viruses, or other malware.
12 You have a legal title to the offers and any promotion you post on your Account profile.

‍YOUR CONDUCT
‍You will not post or upload on the website or mobile application, offers or promotions that include the following
1. Any offer which is prohibited by applicable law.
2. Incites violence and unlawful actions.
3.  Identifying information about minors.
4.  Pornographic, overly sexual materials or content.
5. Deceptive comments, statements or content.
6.  Defamatory, discriminatory, harassing, abusive language.
7.  Offers of prostitution or other services contradicting moral or legal norms.
8.  Direct or indirect references to any other websites competing with us (Bisame).

YOUR PRIVACY

‍INDEMNITY

‍You agree to indemnify and hold Bisame Digital Ltd, its directors, shareholders, and all third-party associates harmless from any claim or demand, including costs and attorney fees made by any third party due to or arising out of your use of our website and any violation of warranty, representation or obligation in these terms.

‍AS PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Bisame, ITS DIRECTORS,SHAREHOLDERS, AND OTHER SUBSIDIARIES, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS BE LIABLE FOR ANY DIRECT OT INDIRECT LOSTPROFITS, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROMTHESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SERVICEOR THIRD-PARTY ADS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCHDAMAGES. USE OF OR ACCESS TO, THESERVICE AND THIRD-PARTY ADS ARE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BESOLELY RESPONSIBLE FOR ANYDAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA RESULTING THEREFROM.NOTWITHSTANDING ANYTHING TO THE CONTRARY STATED HEREIN, YOU AGREE THAT THEAGGREGATE LIABILITY OF Bisame TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THEUSE OF SERVICE, CONTENTS AND OFFERS ARE LIMITED.THE LIABILITY LIMITATIONS IN THIS SECTION ARE NOT INTENDED TO LIMIT ANYWARRANTY PROVIDED IN THE APPLICABLE TERMS OF SERVICE STATED ON THIS PAGE NORARE THEY INTENDED TO LIMIT REMEDIES YOU MIGHT HAVE FOR SERVICE-RELATEDPROBLEMS.

‍INTELLECTUAL PROPERTY RIGHTS

‍All data (User Content) you submit as part of the registration requirements remain your intellectual property, and we do not have the right to claim any ownership, copyright or any other proprietary intellectual property rights for USER CONTENT.

Moreover, you agree that we may retain copies of all registration information which shall be reasonably used in compliance with the terms set out in these terms of service policy. You grant the right to copy, modify, adapt, store, publish, distribute and publicly display, communicate and make available the user content relating to the Service for Bisame’s marketing, advertising, and other purposes. You agree and warrant that your use of the service will neither infringe nor violate the right of any other party. All Contents and materials on the website, except the User and Business Account and User and Business Trademarks, User Service Marks, and Logos belong to or are licensed by Bisame Digital Ltd. representing items of copyright and any other intellectual property rights. Any use of such material or content without prior notice from us is not allowed.

‍DISPUTE RESOLUTION

‍All or any other part of these TERMS shall be enforced by the laws of Ghana. Any dispute or claim arising out or in relation to a breach of or termination of contract shall be settled by the Ghana Arbitration Centre in accordance with its Rules. The mode of language for proceedings will be English in case there are disputes to be settled.
